TERMS FRAMEWORK
Plain-language rules for
using ConvertClarity.
This is the current commercial terms framework for launch preparation. It is not yet an effective contract. The operating legal entity, notice address, governing law and final legal approval must be added before general availability.
Status: review draft dated October 3, 2026. Do not rely on this page as executed terms. A customer-specific order form or later effective Terms of Service controls only after it identifies the service provider and effective date.
1. Service and account
ConvertClarity provides behavior analytics, session replay, heatmaps, funnels and evidence-based conversion hypotheses. Customers must provide accurate account information, protect credentials, authorize users appropriately and remain responsible for activity in their workspace.
2. Trial, fees and renewal
Plans begin with a 30-day trial when a valid payment method is supplied. Unless canceled before the trial ends, the selected monthly subscription renews automatically at the displayed price plus applicable taxes. Customers may manage or cancel through the billing portal. Refund, failed-payment and price-change provisions require final operator approval before these terms become effective.
3. Customer data and privacy
The customer controls the websites and visitor data submitted to the service. The customer must provide required notices, obtain required consent, choose a lawful basis, configure masking and exclusions, and honor data-subject requests. Customers must not submit payment-card data, credentials, health data, government identifiers or other sensitive data. Processing terms are described in the DPA framework.
4. Acceptable use
Customers may not use the service unlawfully; track a property without authority; defeat consent controls; collect prohibited sensitive data; probe or disrupt the service; distribute malware; reverse engineer protected service components; resell access except under an authorized agency plan; or exceed plan limits through circumvention.
5. Intellectual property and feedback
Customers retain rights in customer data. ConvertClarity retains rights in the service, software, documentation and aggregated service learnings that do not identify a customer or visitor. Customers grant only the rights needed to operate and secure the service. Product feedback may be used without restriction or attribution.
6. Availability, changes and beta features
The service may change as it develops. Maintenance, security events and third-party infrastructure may affect availability. Beta or preview features may be changed or withdrawn and should not be used for mission-critical decisions without independent validation.
7. Recommendations and results
Conversion recommendations are hypotheses derived from observed evidence, not guarantees of revenue, conversion improvement or legal compliance. Customers remain responsible for experiment design, business decisions and outcome validation.
8. Suspension and termination
Access may be suspended for security risk, unlawful use, nonpayment, material breach or protection of the service and other customers. On termination, collection stops and customer data is deleted under the applicable retention and deletion process, subject to legal obligations and backups.
9. Warranties, liability and indemnity
Final warranty disclaimers, liability caps, exclusions, indemnities, dispute procedure and governing law must be approved for the operating entity and customer market before these terms become effective. They are intentionally not invented on this page.
10. Contact and notices
The legal provider name, postal notice address, privacy contact and support contact are pending operator confirmation. Those fields are launch blockers and must appear here before customers are bound.
